To sue (you're the plaintiff)

  • Small Claims Affidavit (SC Form 01)

    What to know
    • This is the Wyoming Judicial Branch's form. A small claims case is for money owed when "The amount that is owed to you must be $6,000 or less" and "You already demanded payment and the other person refused to pay" (the instructions, SC Form 01a; W.S. 1-21-201, 1-21-202(a)).
    • File it with the Clerk of Circuit Court. "A defendant in small claims actions may be sued in the county in which the defendant has an address or where the cause of action or some part thereof arose" (Rule 4, Rules Governing Small Claims Cases). "The Filing Fee is $10.00" and it is printed in the chart (the instructions, SC Form 01a; Rule 3). Take two extra copies; the Clerk's Office charges for copies, at least $1.00 per page (the instructions, SC Form 01a).
    • If the claim is for a residential security deposit: the owner must deliver or mail the balance and a written itemization of deductions within thirty (30) days after the rental agreement ends or fifteen (15) days after receiving your new mailing address, whichever is later, extended by thirty (30) days if there is damage; if the owner unreasonably fails to, "the renter may recover the full deposit and court costs" (W.S. 1-21-1208(a), (c)).
    • Choose your county from the list at the top and check the judicial district: Vera leaves the county to you and fills the district only when your court's name says it; in some PDF viewers the form fills the district itself from the county you choose. When you file, the Clerk of Circuit Court can give you this information, and the case number (the instructions, SC Forms 01a and 05).
    • Vera filled you as Plaintiff, the other side as Defendant, the case number if your case has one, and your printed name. From your answers in Court forms it filled the Principal in section 1 and the Prejudgment Interest if you ask for interest, why the Defendant owes you in section 2 (what the money is for, and how you added it up), box 4 if you asked the Defendant to pay first, box 6 if you said the Defendant is not on active military duty, the Defendant's phone, mailing address and email in section 7, and your phone number, mailing address and email address under the signature. Check each one (the form).
    • Still yours: the interest if Vera did not fill it, attorney fees, service fees and the TOTAL in section 1 (the filing fee of $10.00 is printed), boxes 3 and 5, the Defendant's employer's address, and the Defendant's email if Vera did not fill it. The caption has one Defendant line: if you are suing a second defendant, ask the Clerk of Circuit Court how to name them before you file. Check boxes 4 and 5 only if they are true: "If you cannot honestly check this box, your situation does not qualify for a small claims court case in Wyoming." Do not change sections 8 and 9 (the instructions, SC Form 01a).
    • "Do not sign this form until you are in front of the Clerk of Court or a Notary." By signing you say everything on the form is true; add the date and your work address. The Clerk or Notary fills out the part that begins "subscribed and sworn." Vera never signs or dates a form (the instructions, SC Form 01a).
    • Take with you the Small Claims Summons (SC Form 02, below), a blank Return of Service by Sheriff or Deputy (SC Form 03) and a blank Affidavit of Service (SC Form 04), and copies of any invoices, receipts or agreements; keep your originals. "Do not write anything on the Return of Service or the Affidavit of Service." Vera does not fill them (the instructions, SC Forms 01a and 05).
    • You may bring the case yourself: parties "may litigate actions on behalf of themselves in person or through authorized employees, with or without an attorney"; if an attorney appears, the other side is entitled to a continuance to get one (W.S. 1-21-202(b)).
    • Court Clerks are not allowed to help you fill out these forms (the instructions, SC Form 01a).

  • Small Claims Summons (SC Form 02)

    What to know
    • This is the Wyoming Judicial Branch's form; take it to the Clerk of Circuit Court with the Small Claims Affidavit (the instructions, SC Form 05).
    • Choose your county from the list at the top and check the judicial district: Vera leaves the county to you and fills the district only when your court's name says it; in some PDF viewers the form fills the district itself from the county you choose. When you file, the Clerk of Circuit Court can give you this information, and the case number (the instructions, SC Forms 01a and 05).
    • Vera filled you as Plaintiff, the other side as Defendant and the case number if your case has one. Fill them in "exactly the same way you did on the Small Claims Affidavit." "DO NOT write anything else on the Summons. The Clerk, or someone else at the Court, will fill out the rest of the page." (the instructions, SC Form 05).
    • "In a small claims case, the Court is responsible for making sure these documents are given to the Defendant" (the instructions, SC Form 05): by certified mail or by a Sheriff or process server (the Summons; W.S. 1-21-203(a)). The hearing date must be not more than twenty (20) days nor less than twelve (12) days from the date of service (W.S. 1-21-204).
    • "The Plaintiff is required to appear at this hearing." Bring your witnesses and documents (the Summons). The Court gives you and the Defendant a completed Summons that says when and where the hearing is (the instructions, SC Form 05).

If you were sued (you're the defendant)

  • "No answer nor responsive pleading shall be required in small claims actions" (Rule 5, Rules and Forms Governing Small Claims Cases); "No formal pleading other than the claim and notice is necessary" (W.S. 1-21-205).
  • The Summons gives the hearing date and place, set not more than twenty (20) nor less than twelve (12) days from the date of service (the Summons, SC Form 02; W.S. 1-21-204).
  • "You are asked to tell the Court if you plan to take part in the hearing" by calling the Circuit Court Clerk's Office the business day before the hearing (the Summons, SC Form 02).
  • "If the Defendant does not take part in or appear at the hearing, judgment may be entered as requested in the Plaintiff's Small Claims Affidavit." Bring your witnesses and documents (the Summons, SC Form 02).
  • You may appear yourself, through authorized employees, or with an attorney; if the plaintiff's attorney appears, you are entitled to a continuance to get your own (W.S. 1-21-202(b)).
  • An appeal to district court is only "on questions of law and not for a review of the sufficiency of evidence" (Rule 7, Rules and Forms Governing Small Claims Cases).
